Why You Should Have Your Conveyancing Solicitor Review Your Queensland REIQ Contract

The REIQ Contract of Sale is the standard form contract used for the sale of residential property across Queensland. While it is a widely used and well-established document, the fact that it is a standard form does not mean it is one-size-fits-all and signing one without legal advice can expose you to significant risk.

Real estate agents in Queensland are authorised to prepare an REIQ contract on behalf of a seller, but they are not qualified to provide legal advice about its contents. An agent's priority is to facilitate a sale; your conveyancer's priority is to protect your legal interests.

There are several important reasons to have your conveyancing solicitor review your REIQ contract before it is signed:

  • The standard conditions may not suit your situation. The REIQ contract includes default conditions around finance, building and pest inspections, and settlement timeframes. These defaults may not reflect what you have agreed with the buyer, or may leave you exposed if the buyer attempts to terminate the contract on a technicality.
  • Special conditions need careful drafting. Any special conditions added to the contract — such as subject to sale of another property, early access arrangements, or inclusions and exclusions — must be drafted carefully to be legally enforceable. Poorly worded special conditions are a common source of disputes.
  • Disclosure obligations must be met. Under Queensland's updated property legislation, sellers have mandatory disclosure obligations. Failing to meet these obligations can give a buyer the right to terminate the contract or seek compensation.   • Title and encumbrance issues should be identified early. Your conveyancer will review the title to identify any easements, caveats, or encumbrances that need to be disclosed or dealt with before settlement.
